Oklahoma Sex Offender Registration

If you have been convicted of a sex-related offense in Oklahoma, the law requires that you meet the sex offender registration requirements upon your release from incarceration. Those that must comply with the sex offender registration requirements include those people who have been found to be habitual sex offenders and/or aggravated sex offenders. There are serious consequences involved for any failure to register, and each of these issues is explained below.

Sex Offender Registration Requirements

Oklahoma has a law in place that's called the Sex Offenders Registration Act, and it lays out the details of registration for those who are considered by the law to be habitual sex offenders or aggravated sex offenders. These requirements include:

Any person who becomes subject to the provisions of this act shall:

  1. Register with the Department of Corrections within ten (10) business days of being convicted or receiving a suspended sentence if the person is not incarcerated, or within ten (10) business days of release of the person from a correctional institution;
  2. Register with the local law enforcement authority having jurisdiction in the area where the person resides or intends to reside for more than seven (7) days. The registration is required within seven (7) days after entering the jurisdiction of the law enforcement authority

If a person was convicted of a related offense after November 1, 1989 in another jurisdiction and would have fallen under the requirements of this statute in Oklahoma must:

  1. Register with the Department of Corrections when the person enters and intends to be in the state for thirty (30) days or longer. Such registration is required within thirty (30) days after entering the state; and
  2. With the local law enforcement authority having jurisdiction in the area where the person intends to reside or to stay for more than seven (7) days. The registration is required with local law enforcement within seven (7) days after entering the jurisdiction of the law enforcement authority.

This registration must be up-to-date for a period of ten years, or for a period of two years if the person at issue completes the sex offender treatment program provided by the Department of Corrections.

Failure to Register as a Sex Offender in Oklahoma

Any person found to be a habitual sex offender or an aggravated sex offender must maintain compliance with the requirements of sex offender registration. These requirements include not only maintaining current contact information with the proper authorities, but habitual sex offenders or aggravated sex offenders must also submit to DNA gathering and other requirements.

The Sex Offenders Registration Act also lays out penalties if any part of these registration requirements is not met. Failure to register and comply with the Act is a felony offense punishable by up to five years in prison. Therefore, you need to understand all the requirements involved and how to maintain compliance in order to avoid these sanctions.
